. . . and heaven help you if you take an ordinary cold tablet! I know
someone who did (it was my fault: everyone had had a killer cold/flu and
when he got it he was coughing so hard he could hardly stand up, so I
gave him a couple of cold tablets so he could make it on his moorcycle
to his test.) They were definitely trying to "get" him anyway (bad
attitude, you know) and were making him come in three or four times a
week. He had no phone, so he had to call them late every afternoon to
find out whether he should go in the next day. They - quite knowingly, I
think - made it impossible to keep a job, and although there was a plac
where he could have gotten his test much closer, made him go to another,
more distant town for them. After the cold tablet, he tested positive
and had to go to court. We went to the library and did some frantic
research and came up with medical information in the Congressional
Record - and elsewhere - showing that the cold tablets he took would
test positive for methamphetamine - as happened. He had been submitting
to the tests for some time and had been clean, but all the research we
did was in vain, as the judge would not consider evidence unless he was
charged with a crime and had a trial or something, in which case, his
public defender warned, he might go to jail for years. The judge said
that if we demanded a trial, or any consideration of the evidence that
he was NOT taking amphetamines, he would have to go to jail right then
and we would have to bail him out - IF we could. As it was, he was
supposed to come back another day for sentencing. He left the state, got
ticket in another state and was arrested, but the state of California
declined to extradite him - so he lives there and does okay - but he
can't leave the state or come home, because the state of California has
not dropped the charges, either. Since the original offense was a felony
(he fired one bullet into the air, harming no one - it wasn't even his
gun:a neighbor handed it to him during a dispute in which he was being
threatened and he fired the bullet) consequences could be the original
five years he was sentenced to, and which was then suspended. Or he
might qualify for life under three strikes. As it is, he is a
hard-working taxpaying, rather straight kind of guy who just happens to
have long hair and irritates people in the legal profession by his lack
of proper respect for them and their dumb laws.
